Terms of Service

Last updated: September 2026

These Terms of Service ("Terms") govern your access to and use of the Via-U CRM platform. By creating an account or using the service, you agree to these Terms. If you do not agree, please do not use the platform.

1. About the service

Via-U CRM is a cloud-based CRM and business management tool for freelance and bridal makeup artists. Features include client management, calendar bookings, trials and face charts, quotes, invoices, contracts, e-signatures, messaging, a client portal, kit and expense tracking, analytics and an AI help assistant.

2. Eligibility and account types

  • Artist accounts: for individual makeup artists and small studio operators. Artists are responsible for the accuracy of the client details, documents and payment information they add.
  • Client accounts: for clients invited by an artist. Clients may view shared bookings, documents and messages, and update their own profile details. Client accounts are also bound by these Terms. The artist, not Via-U CRM, decides what information about a client is collected and stored, and questions about that information should be directed to the artist in the first instance.
  • You must be at least 18 years old to hold an account. You must provide accurate information and keep your login credentials secure. Sign-in is protected by a one-time verification code sent to your email address. Never share that code with anyone.

3. Subscriptions, billing and cancellation

  • Artist accounts start with a 30-day free trial. No payment card is required during the trial.
  • After the trial, the Studio plan is billed at the price shown on the website — currently $25 AUD per month, or $270 AUD per year if you choose yearly billing. Payments are processed through Stripe. You can switch between monthly and yearly billing at renewal.
  • You can cancel at any time from your Settings. Cancellation stops future billing, but you keep full access until the end of your current paid period. After that, your account becomes read-only until you re-subscribe. Your data is not deleted unless you choose to delete your account.
  • If a payment fails, we will notify you and attempt the payment again. If payment has not succeeded 7 days after the first failure, your account becomes read-only. Your data remains viewable, and full access returns as soon as a payment succeeds.
  • If you delete your account, your subscription is cancelled and no further payments are taken after the end of the current paid month. If you are on a yearly plan, you may request a refund of the unused whole months remaining in that year by contacting us; refunds are calculated from the end of the month in which you delete your account.
  • Apart from the yearly refund described above, and apart from any refund you are entitled to under the Australian Consumer Law, no refunds are provided for part-months or for periods during which the service was available to you.

4. Your content and responsibilities

You retain ownership of the client details, photographs, documents and notes you upload. You grant us a non-exclusive, royalty-free licence to host, store, back up, reproduce, process and display that content, and to sub-licence those rights to our hosting and infrastructure providers, solely so that we can provide and support the service. That licence ends when the content is deleted, except for copies retained in backups until those backups expire.

You agree not to upload illegal, infringing or harmful material, and not to use the platform to harass, spam or mislead anyone.

5. Documents, quotes, invoices and payments

The platform helps you create quotes, invoices and service agreements. You are responsible for the legal content and accuracy of any document you send to a client, including the payment details shown on it. We are not a law firm and do not provide legal, accounting or tax advice.

Subscription payments to Via-U CRM are processed by Stripe and are subject to Stripe's terms. Payments made to you by your own clients are arranged between you and your client; Via-U CRM does not process, hold or guarantee them.

6. Electronic signatures

The platform allows documents to be signed electronically. Electronic signatures are generally effective in Australia under the Electronic Transactions Act 1999 (Cth) and its State and Territory equivalents. We do not warrant that any particular document you create or have signed is valid, enforceable or suitable for your purpose. That is a matter for you and, where appropriate, your own legal adviser.

7. Messaging and communications

Messages sent through the in-app messenger stay within the platform. If you connect email, SMS, WhatsApp or Instagram channels, you are responsible for complying with anti-spam laws and for obtaining any consent required from your clients.

8. AI assistant

The AI assistant generates responses automatically and can be inaccurate, incomplete or out of date. It does not provide legal, financial, tax or other professional advice. You must check anything important before relying on it, particularly before sending a document to a client. You remain responsible for everything you send.

Prompts and responses may be processed by third-party AI providers as described in our Privacy Policy. Do not enter information you are not permitted to disclose to them.

9. Your clients' information

When you add a client's personal information — including names, contact details, event details, notes and photographs — you warrant that you are entitled to collect and upload it and have obtained any consent required, including consent to store and display photographs. You are responsible for complying with the Privacy Act 1988 (Cth) in your own business.

You indemnify us against claims brought by your clients that arise directly from information you upload or documents you send, except to the extent the claim arises from our breach of these Terms or our negligence.

10. Acceptable use

You must not use the platform to store or send unlawful, infringing, misleading, harassing or harmful material; attempt to access another account's data; probe, scan or test the security of the platform except with our written permission; use automated means to extract data at scale; or resell or white-label the service without our agreement.

11. Intellectual property

The Via-U CRM name, logo, software, designs and templates are owned by us or our licensors. You may not copy, reverse-engineer or resell the platform. The documents and templates you create inside your account are yours.

12. Data, security, backups and your own copies

We take reasonable care to keep your data secure and available. This includes access controls that restrict each account to its own data, encryption of data in transit, verification of sign-in by a code sent to your email address, and routine backups of the platform.

No online system is perfect. We do not warrant that the service will be uninterrupted, error-free, or free from loss, corruption, attack, virus, interference or hacking. Backups are maintained for our own operational recovery and are not an individual file-retrieval service. Where we agree to restore data at your request, we may charge a reasonable fee.

The platform is not a substitute for your own business records. You are responsible for keeping your own copies of the information you need to run your business, including client details, quotes, invoices, contracts, signed documents, expense records and photographs. You can export your data at any time from Settings. We recommend you export regularly, and in every case before you cancel your subscription, delete your account, or make significant changes to your data.

If your subscription ends or your account is terminated, your data remains available to you in read-only form for 30 days so that you can export it. We may permanently delete your data 90 days after that period ends, and we will give you at least 14 days' notice by email before doing so.

Subject to clause 14.1, we are not liable for loss, corruption or unavailability of data except to the extent caused by our failure to take reasonable care, and our liability for any such loss is subject to clauses 14.2 to 14.6.

If a data breach occurs that is likely to result in serious harm, we will notify affected users and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).

13. Termination

You may delete your account at any time. We may suspend or terminate access if you breach these Terms, misuse the service, or where required by law.

Where a breach can be remedied, we will give you notice and at least 14 days to remedy it before suspending or terminating your account, unless the breach is serious, unlawful, or creates a risk to other users or to the security of the platform, in which case we may act immediately.

On termination, your right to use the service ends. Your stored data is handled as described in clause 12 and in our Privacy Policy.

14. Liability

14.1 Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right, warranty or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.

14.2 Limitation where permitted. Where we are entitled to limit our liability for failure to comply with a consumer guarantee, other than in respect of goods or services of a kind ordinarily acquired for personal, domestic or household use or consumption, our liability for that failure is limited, at our option, to resupplying the services or paying the cost of having the services resupplied.

14.3 Excluded loss. Subject to clause 14.1, we are not liable to you for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill, anticipated savings, business opportunity, or loss or corruption of data, however arising, whether in contract, tort (including negligence), statute or otherwise.

14.4 Cap. Subject to clause 14.1, our aggregate liability to you for all claims, whether individually or in aggregate, arising in any twelve-month period is limited to the total fees you have paid us in the twelve months before the first event giving rise to the claim.

14.5 Your contribution. Subject to clause 14.1, we are not liable for loss to the extent it is caused or contributed to by you, including inaccurate or incomplete information you enter, the content of documents you send to your clients, your failure to keep your login credentials or verification codes secure, your use of third-party channels, or your failure to keep your own copies of your data under clause 12.

14.6 Third parties. We are not liable for the acts, omissions, outages or security failures of third-party services the platform relies on or that you choose to connect, including payment processing, email, SMS and messaging providers, and hosting and AI providers. Your use of those services is subject to their own terms.

15. Changes to these Terms

We may update these Terms as the service changes. For changes that materially affect your rights, we will give you at least 30 days' notice by email before they take effect. If you do not accept a material change, you may cancel your subscription before it takes effect and we will refund the unused portion of any period you have paid for. Minor changes and changes required by law may take effect immediately.

16. Force majeure

Neither party is liable for a failure to perform caused by events beyond its reasonable control. This does not apply to obligations to pay money.

17. General

These Terms are the entire agreement between us on this subject. If any provision is unenforceable, it is severed and the rest continues in force. We may assign these Terms to a related entity or on a sale of the business, on notice to you; you may not assign without our consent. Clauses 4, 9, 11, 12, 14 and 17 survive termination.

18. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the parties submit to the jurisdiction of the courts of New South Wales. Nothing in this clause displaces the Australian Consumer Law, which applies throughout Australia.
